1. Acceptance of Terms

By accessing or using Sorte.io's services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms. If you do not agree to these Terms, you must not use the Service.

Sorte.io provides end-to-end technology solutions including but not limited to:

• Web application development and hosting
• Infrastructure as a Service (IaaS)
• Platform as a Service (PaaS)
• Database management
• Cloud computing services
• DevOps and CI/CD pipelines
• Monitoring and analytics
• Security and networking services

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Account Terms

3.1 Account Creation

You must provide accurate, complete, and current information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Age Requirement

You must be at least 18 years old or the age of legal majority in your jurisdiction to use the Service.

3.3 Account Security

You must immediately notify us of any unauthorized use of your account. We will not be liable for any loss or damage arising from your failure to maintain the security of your account.

4. Payment Terms

4.1 Billing

• All payments are processed through Paddle
• Subscription fees are billed in advance on a monthly or annual basis
• All fees are exclusive of taxes unless otherwise stated
• Paddle will handle all applicable taxes including VAT/GST

4.2 Free Trial

We offer a 14-day free trial. No credit card is required to start a trial. If you do not cancel before the trial ends, you will be charged for the selected plan.

4.3 Price Changes

We reserve the right to modify pricing with 30 days' notice. Price changes will take effect at the start of the next billing cycle.

5. Acceptable Use Policy

You agree not to use the Service to:

• Violate any laws or regulations
• Infringe upon intellectual property rights
• Transmit malware, viruses, or malicious code
• Engage in cryptocurrency mining without explicit permission
• Send spam or unsolicited communications
• Attempt to gain unauthorized access to systems or networks
• Engage in activities that harm minors
• Host content that is defamatory, obscene, or offensive
• Resell the Service without written permission

5.1 Resource Usage

Fair use policies apply to all plans. Excessive use of computational resources, bandwidth, or storage may result in additional charges or service limitations.

6. Data Ownership and Privacy

6.1 Your Data

You retain all rights to your data. We claim no ownership over any content you upload or create using the Service.

6.2 Data Processing

We process data according to our Privacy Policy. By using the Service, you consent to such processing.

6.3 Backups

While we perform regular backups, you are responsible for maintaining your own backups of critical data.

7. Service Level Agreement

7.1 Uptime Commitment

We strive for 99.9% uptime for all production services. This excludes scheduled maintenance, which will be announced at least 48 hours in advance.

7.2 Support

• Starter Plan: Email support, 48-hour response time
• Professional Plan: Priority email support, 24-hour response time
• Enterprise Plan: 24/7 phone and email support, 1-hour response time for critical issues

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SORTE.IO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability shall not exceed the amount paid by you to Sorte.io in the twelve (12) months preceding the claim.

8.1 Indemnification

You agree to indemnify and hold harmless Sorte.io from any claims arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

9. Termination

9.1 Termination by You

You may terminate your account at any time through your account settings or by contacting support. Termination will take effect at the end of your current billing period.

9.2 Termination by Us

We may suspend or terminate your account immediately if:

• You violate these Terms
• You fail to pay fees when due
• Your use of the Service poses a security risk
• We are required to do so by law

9.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We will retain your data for 30 days after termination, after which it may be permanently deleted.

10. Paddle as Merchant of Record

Paddle.com Market Limited (Paddle) is the Merchant of Record for all our transactions. This means:

• Paddle is the seller of the Service for legal and tax purposes
• Customer inquiries regarding payments should be directed to Paddle
• Paddle handles all payment processing, invoicing, and tax collection
• Refunds are processed according to Paddle's policies in conjunction with our Refund Policy

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or through the Service at least 30 days before they take effect. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
